Terms and Conditions of Use

1. Introduction

Welcome to Lumis (“the Platform”), an online learning management system operated by Surgo (Pty) Ltd (“Surgo”, “we”, “us”, or “our”).

By accessing or using the Lumis website and services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, you may not access or use the Platform.

2. Eligibility

Lumis may not be used by individuals under the age of 16. By accessing or using the platform, you represent and warrant that:

  • You are at least 18 years old, or

  • You are between the aged of 16 and 17 and have obtained the consent of a parent or legal guardian to use the Platform; and

  • You have the legal capacity to enter into a binding agreement in accordance with applicable law.

We reserve the right to suspend or terminate accounts where eligibility requirements are not met.

3. Account Registration

To access certain features, you must create an account.

You agree to:

  • Provide accurate and complete information.

  • Keep your login credentials secure.

  • Accept responsibility for all activity under your account.

Surgo reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Quests (Courses) and Purchases

Lumis offers learning experiences referred to as “Quests.”

Some Quests may be free. Others may require payment.

4.1 No Refund Policy

All purchases of paid Quests are final.

  • No refunds will be provided once a Quest has been purchased.

  • Users are responsible for reviewing Quest descriptions carefully before purchase.

  • The Platform does not allow duplicate purchases of the same Quest.

  • By completing a purchase, you acknowledge and accept that the transaction is final.

This policy applies regardless of:

  • Partial completion

  • Non-completion

  • Change of mind

  • Technical issues outside of Surgo’s control

5. Lumos Rewards

Lumis may include a gamification system where users earn virtual rewards known as “Lumos.”

  • Lumos have no monetary value.

  • Lumos cannot be exchanged for cash.

  • Surgo reserves the right to modify, suspend, or discontinue the Lumos system at any time.

6. Intellectual Property

All content on the Platform, including but not limited to:

  • Course materials

  • Videos

  • Text

  • Graphics

  • Logos

  • Designs

  • Assessments

  • Certificates

  • Branding elements

  • Software and platform structure

are the exclusive property of Surgo (Pty) Ltd or its licensors.

6.1 Restrictions

You may not:

  • Copy, reproduce, distribute, or republish content.

  • Sell, sublicense, or commercially exploit any materials.

  • Share course materials outside the Platform.

  • Record, download, or redistribute video lessons.

  • Reverse engineer or attempt to extract source code.

Access to content is licensed, not sold.

Violation of intellectual property rights may result in:

  • Immediate account termination

  • Legal action

  • Claims for damages

7. Acceptable Use

You agree not to:

  • Use the Platform for unlawful purposes.

  • Upload malicious code or interfere with system integrity.

  • Attempt to gain unauthorized access to other accounts.

  • Harass, abuse, or disrupt other users.

  • Share your login credentials with others.

Surgo reserves the right to suspend or terminate accounts that violate these rules.

8. User Conduct in Live or Interactive Sessions

Where applicable, users must:

  • Behave respectfully during live sessions.

  • Not record live sessions without authorization.

  • Not distribute session materials externally.

9. Certificates

Certificates issued upon completion of Quests:

  • Represent completion of the stated course requirements.

  • Do not constitute formal accreditation unless explicitly stated.

  • May not be altered or misrepresented.

10. Privacy and Data Protection

Surgo processes personal information in accordance with applicable data protection laws, including POPIA where applicable.

By using Lumis, you consent to:

  • Collection of necessary personal information.

  • Storage and processing of data for educational and operational purposes.

  • Communication regarding your account and Quests.

11. Platform Availability

While we strive for uninterrupted access, Surgo does not guarantee that:

  • The Platform will always be available.

  • The Platform will be free of errors or interruptions.

We reserve the right to:

  • Modify or discontinue features.

  • Update content.

  • Perform maintenance without prior notice.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Surgo shall not be liable for indirect, incidental, or consequential damages.

  • Surgo is not responsible for personal decisions made based on course content.

  • Users are responsible for applying knowledge appropriately.

13. Termination

Surgo may suspend or terminate your account if you:

  • Breach these Terms.

  • Violate intellectual property rights.

  • Engage in unlawful or disruptive conduct.

Upon termination, access to purchased Quests may be revoked.

14. Amendments

Surgo reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of updated Terms.

15. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.
